Types of local council investigations ProFact conducts
ProFact is regularly briefed by local councils across Australia on matters where impartial factual inquiry, field surveillance or documented evidence is required. Each instruction is scoped by a senior investigator, conducted lawfully under agreed written terms, and reported in a form suited to council governance, regulatory response or proceedings.
Development consent disputes
A common council instruction involves gathering evidence that premises are being used inconsistently with development consent, including therapeutic massage premises operating as brothels or businesses run from residential zones where use is not permitted. These matters require lawful, detailed field evidence presented in a form that can support council action or Land and Environment Court proceedings where required.
Illegal backpacker lodgings
In tourism-dependent areas, councils frequently receive complaints about premises operating as backpacker accommodation without approval. Unlawful lodgings carry serious community and safety implications if complaints are not investigated properly. ProFact conducts locate, surveillance and factual inquiries to establish occupancy and use so councils can act on resident and ratepayer concerns.
Employee misconduct and theft of time
Non-compliance with agreed hours of duty remains a significant issue for local government employers. Manipulation of working hours is effectively the theft of wages and can carry substantial productivity and insurance exposure over time. ProFact gathers lawful surveillance and factual evidence to help councils address attendance abuse and support disciplinary or recovery action.
Vandalism and malicious damage
Increased antisocial behaviour has left many councils facing recurring repair costs for damaged public property. ProFact undertakes field inquiries to identify persons responsible, capture video and photographic evidence, and provide locator detail that supports council messaging, cost recovery and referral for further action.
Late trading and noise complaints
Complaints from residents near hotels and entertainment venues with extended trading permits often require impartial technical evidence rather than anecdote alone. ProFact is instructed to lawfully video and record sound so councils receive an independent report from which to assess noise complaints and licensing decisions.
Workplace surveillance authorities
The NSW Workplace Surveillance Act permits employer surveillance in defined circumstances where appropriate court authority is obtained by a licensed private investigator. ProFact holds NSW Security Master Licence #000111294 and can support council employers with lawfully authorised workplace surveillance for theft of time, asset misappropriation or workers compensation verification where council is employer and insurer.
Theft and misuse of council assets
Councils can sustain significant losses through theft of building supplies, fuel, tools, plant and unauthorised use of equipment for private benefit. ProFact gathers the factual and surveillance evidence required, prepares statements of fact and can liaise with police to support lawful recovery and prosecution where scope permits.
Fraud, insurance claims and corrupt conduct
ProFact investigates obtaining benefits by deception, false instrument matters and long-running account fraud, including fuel and waste services irregularities identified through surveillance and interview. We also conduct factual and surveillance inquiries on injury and liability claims, and impartial corrupt conduct investigations where councils must avoid using internal resources for suspected corruption matters under ICAC expectations.
